A Client Guide to Contested Probate

Most contested probate matters resolve through negotiation or mediation within twelve to eighteen months. A minority proceed to trial, and those are the cases that shape expectations unhelpfully.

Costs risk is the single most important issue to understand early: the general rule is that costs follow the event, with limited exceptions where the testator or those interested in the residue caused the litigation.

We will always tell you when a claim is not worth bringing. That advice is part of the service.
